Annex 1 Mandatory Conditions
Mandatory conditions where licence authorises supply of alcohol
1 No supply of alcohol may be made under the premises licence:-
a at a time when there is no designated premises supervisor in respect of the premises licence,
or
b at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
2 Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3 The premises licence holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
Annex 2 Conditions consistent with operating schedule
Prevention of Crime and Disorder
1 The licence holder shall ensure that alcohol is delivered in the appropriate van only with a main meal order of food.
2 The licence holder shall ensure that either CCTV or an EPOS System is installed both in the premises and in the all delivery vans that will be used for delivering the food and/or alcohol orders.
3 The licence holder shall ensure that no alcohol is consumed within the premise boundaries.
4 The licence holder shall ensure that alcohol is only delivered by persons who hold a personal licence and that all transactions where alcohol is being delivered are conducted from the delivery van and not on or to the doorstep of the customer.
5 The licence holder shall operate a policy of NO ID - NO SALE for the sale of alcohol and tobacco products on the premise. This policy will also apply when delivering alcohol where ID can be monitored by recording it on the CCTV system.
6 A copy of menus or leaflets used to promote/advertise food or alcohol available for order/sale will be made available to the RMBC Licensing Office and South Yorkshire Police Licensing Office for approval.
7 The licence holder shall ensure that no alcohol will be on general view to customers at the main food outlet or van.
8 The licence holder shall ensure that there shall be no promotion of the delivery of alcohol that encourages customers to have alcohol delivered.
9 The licence holder shall ensure that the delivery vans used and any works or fittings, including fitting CCTV and cabinets, carried out on the vans relating to the carrying of alcohol and security of the vehicles shall be with the approval of the Police and Licensing Authority.
Public Safety
None.
Prevention of Public Nuisance
10 The licence holder shall ensure that checks are carried out on a daily basis to ensure that no litter from the premises has been dropped by customers.
11 The licence holder shall ensure that all entrances and exits are clear of any obstructions at all times.
Protection of Children from Harm
12 The licence holder shall ensure that no children under 12years of age will be served food after 22:00 hours.
13 The licence holder shall ensure that the "Challenge 21" scheme is operated for all alcohol related sales.
