Annex 1 Mandatory Conditions
Mandatory conditions where licence authorises supply of alcohol
1 No supply of alcohol may be made under the premises licence:-
a at a time when there is no designated premises supervisor in respect of the premises licence,
or
b at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
2 Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3 The responsible person will take all reasonable steps to ensure that that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. The premises licence holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
7. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Mandatory conditions where a licence includes a condition requiring door supervisors at specified times (not applicable to Cinemas, Theatres or exclusively Club Premises)
8 All persons primarily engaged under or employed on the premises to vet, regulate and control persons entering the premises; or engaged, used or employed in the supervision of patrons once inside in order to ensure the maintenance of good order, public safety and internal security shall be licensed with the Security Industry Authority.
Where premises licence authorises the exhibition of films:-
9 Where the film classification body is specified in the licence, unless subsection 2(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.
10 Where
a. the film classification body is not specified in the licence, or
b. the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
In this section -
“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).
Annex 2 Conditions consistent with Operating Schedule
General
1. The licence holder shall ensure that no person under the age of 18 shall be admitted to or allowed to enter the premises whilst the club is open for business
2. The licence holder will ensure that performers and employed personnel shall not be aged less than 18 years.
3. The licence holder shall ensure that nothing shall be done, recited, sung, exhibited or preformed which is likely to cause a breach of the peace.
4. The licence holder shall take all reasonable precautions and exercise all due diligence to ensure that soliciting and prostitution does not occur whilst adult entertainment is taking place.
5. The licence holder shall ensure that whilst adult entertainment is taking place only the performers shall provide entertainment, no audience participation must be permitted.
6. The licence holder shall ensure that whilst adult entertainment is taking place, the performer must at all times wear at least a G-string (female) / pouch (male), covering genitalia. This item of clothing must be worn at the commencement of the performance and may be removed during the performance, but must be replaced at the conclusion.
7. The licence holder shall ensure that no performance of adult entertainment shall include any sex act with any other performers, persons in the audience or with the use of any objects.
8. The licence holder must not display outside the premises or on any advertising material photographs or other images that indicate or suggest that erotic dancing takes place on the premises and which may be offensive.
9. The licence holder shall ensure that the Designated Premises Supervisor (DPS) or some other responsible person over the age of 21 years, nominated by the licensee in writing, is in charge and be present on the licensed premises whilst it is open and trading.
10. The licence holder shall ensure that a minimum of three SIA registered door staff are employed on the premise and are present on the premises at such times as the premise is open to the public.
11. The licence holder shall ensure that door supervisors regularly monitor all entrances, exits and toilets.
12. The licence holder must participate in the Local Licensees Radio Scheme.
13. The licence holder shall ensure that CCTV equipment is maintained in good working order and recording kept in date order, numbered consecutively and retained in a secure place for a period of 31 days.
14. The licence holder shall ensure that recordings are made available to the Licensing Authority or a Police Officer on demand.
Prevention of Crime and Disorder
1. The licence holder shall ensure that a CCTV system set up to the minimum approved standards as set by South Yorkshire Police is installed and maintained in working order at all times on the premises.
2. The licence holder shall ensure that a minimum of three SIA registered door staff in attendance at all such times as the premises are open to the public.
3. The licence holder and Designated Premises Supervisor must adhere to the South Yorkshire Police “Drugs & Weapons Policy”.
4. The licence Holder and Designated Premises Supervisor shall maintain membership of Licence Watch Scheme.
5. The licence holder shall ensure that a Personal Licence Holder shall be on the premises at all times the premises is open to the public.
6. The licence holder shall ensure that no drinks or bottles are allowed to be taken from the premises.
7. The licence holder shall ensure that customers are searched on entry to the premises at the discretion of SIA registered door staff or management of the premises.
Public Safety
8 The licence holder shall operate in accordance with Fire Safety Order.
9 A maximum capacity figure shall be set in accordance with a Fire Risk Assessment undertaken on the premises.
Prevention of Public Nuisance
10 The Premises Licence Holder shall ensure that notices are displayed in prominent places about the premises asking customers to be quiet when leaving the premises.
Protection of Children from Harm
No person under the age of 18 years shall be permitted on the premises at such times the sale of alcohol takes place.
Annex 3 Conditions attached after a Hearing of Licensing Authority
The premises shall at all times operate and adhere to ‘Challenge 25’.
