Annex 1 Mandatory Conditions
Mandatory conditions where licence authorises supply of alcohol
1 No supply of alcohol may be made under the premises licence:-
a at a time when there is no designated premises supervisor in respect of the premises licence,
or
b at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
2 Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3 The responsible person will take all reasonable steps to ensure that that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) Provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) Provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. The premises licence holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
7. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Where premises licence includes condition regarding door supervisors:-
Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, the licence must include a condition that each individual must be licensed by the Security Industry Authority.
Annex 2 Conditions consistent with operating schedule
Prevention of Crime and Disorder
1. The licence holder shall be an active member of the Rotherham Licence Watch.
2. The licence holder not employ staff unless they have been properly trained in those aspects of the job which impact on the prevention of crime & disorder; including training on dealing with angry customers and responding to crime & anti-social behaviour.
3. The licence holder shall ensure that the premises are covered by a fully working CCTV system and a Burglar Alarm system front & back.
Public Safety
4. The licence holder shall ensure that no potentially dangerous items such as glass containers or bottles will be left in the easy reach of customers at night.
5. The licence holder shall ensure that all fire risk assessments are in place and maintained and that all fire fighting equipment is maintained and certified.
Prevention of Public Nuisance
6 The licence holder shall ensure that customers are requested to respect the needs of others by arriving and leaving the premises quietly.
7 The licence holder shall ensure that regular/daily checks are made for litter outside the premises; and that litter bins are provided inside and outside the premises.
8 The licence holder shall ensure that they are aware of appropriate guidelines available for licensed premises in the effective management and control of noise.
Protection of Children from Harm
None.
Annex 3 Conditions attached after a Hearing of Licensing Authority
Licensing Hearing to determine Variation Application - Tuesday 2 July 2013
1. The licence holder shall ensure that SIA registered door staff are in attendance on Friday and Saturday nights and on Football Match Days. A risk assessment on whether door staff are required must be carried out on all pre booked functions and a written record maintained of all such assessments.
2. The licence holder shall ensure that a colour CCTV system to the specification of South Yorkshire Police is fitted, maintained and in use at all times whilst the premises are open. The CCTV images will be stored for 31 days and police and authorised officers of the Council will be given access to images for purposes in connection with the prevention and detection of crime and disorder. Members of the management team will be trained in the use of the system. A copy of the specification dated January 2010 will be available at all times for inspection by the Police and Authorised Officers of the Council.
3. The licence holder shall ensure that a minimum of one member of staff is assigned to act as children’s safe guarder at the premise. This role must be fulfilled in line with advice and guidance issued from the Children’s Safeguarding Board.
4. The licence holder shall ensure that the premises operate within the licence conditions and staff ensure that no alcohol is served after the time stated on the licence and premises are promptly closed at stated times.
5. The licence holder shall ensure that a refusal of entry log and ejection log is kept and maintained by staff/security/management and to be produced upon request.
6. The licence holder shall ensure that security staff patrol and monitor inside the venue and the footpath outside the premise.
7. The licence holder shall have a strict policy on the refusal of all customers who are too intoxicated.
8. The licence holder shall operate the ‘Challenge 25’ Proof of age scheme. All customers who appear to be under the age of 25 shall be asked for photographic ID (DVLA driving licence with photograph, Passport or ID card with PASS logo). Evidence shall be shown both upon entry and also at the bar when requesting service.
9. The licence holder shall ensure that all security staff are briefed at the start and end of every shift, which must be logged and signed by all staff in attendance. The briefing shall cover what is required of all staff and to highlight any issues that may have arisen during the night. The log shall be produced upon request by a Police Officer or Authorised Officer of the Council.
10. The licence holder shall maintain and incident log, detailing all incidents both inside and outside the premises with a full report on all large incidents which may occur. The log shall be produced upon request to a Police Officer or Authorised Officer of the Council.
11. The licence holder shall ensure that noise monitoring is carried out during the hours of regulated entertainment. This is to include appointing a competent person to carry out regular noise monitoring visits at the boundary of Keppel Wharf (on Main Street and Market Street) so as to ensure noise from regulated entertainment is not audible at these locations, immediate steps must be taken so as to ensure it is reduced to such a level that it is no longer audible at that location.
12. The licence holder shall ensure that a log of all noise monitoring visits undertaken is made. This is to include dates and times of visits, locations, details of whether noise is apparent and if so, what action has been taken to abate the problem and details of the responsible person undertaking the assessment. The noise monitoring logs will be made available to the Licensing Authority promptly upon request.
Expedited Review - 31 December 2013
Members determined the following:-
1 On New Year’s Day (1 January 2014) the licensed hours will cease at 01.00;
2 Door staff will be employed and on duty whenever members of the public are on the premise;
3 Door staff will use a metal detector wand on every person seeking entry to the premise;
4 Notices to displayed advising customers that searches will be conducted using the metal detector wand;
5 The last person to leave the premise each day/night will be the Designated Premises Supervisor or other nominated paid member of staff;
6 Door staff will conduct searches of all areas of the premise including toilet areas and a log maintained.
Review Hearing - 24 January 2014
Members determined the following:-
1 Reduction in the hours for the sale of alcohol/recorded music:
Monday to Sunday 08.00 to 01.30 the following morning
2 Opening hours of premise:
Monday to Sunday 08.00 to 02.00 the following morning
3 Door staff will be employed and on duty whenever members of the public are on the premise;
4 Door staff will use a metal detector wand on every person seeking entry to the premise;
5 Notices to be displayed advising customers that searches will be conducted using the metal detector wand;
6 Door staff will conduct searches of all areas of the premise including toilet areas and a log maintained.
7 The Designated Premises supervisor will be on the premises at all times the premises is open to the public and will ensure closure of the premise.
