Mandatory conditions where licence authorises supply of alcohol \par \b0\par \b 1\tab\b0 No supply of alcohol may be made under the premises licence:-\par \par \pard\ltrpar\nowidctlpar\fi-720\li720\qj\b\tab a\b0\tab at a time when there is no designated premises supervisor in respect of the premises licence, \par \pard\ltrpar\nowidctlpar\li720\qj or\par \pard\ltrpar\nowidctlpar\fi-720\li720\qj\tab\b b\b0\tab at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.\par \par \b 2\b0\tab Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.\par \pard\ltrpar\nowidctlpar\fi-720\li720\b 3\tab\b0 The responsible person will take all reasonable steps to ensure that that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. \par \pard\ltrpar\nowidctlpar\li720 In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-\par \pard\ltrpar\nowidctlpar\li1440 (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to- \line (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or \par (ii) drink as much alcohol as possible (whether within a time limit or otherwise); \line (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act); \par (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less; \par (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on- \par (i) the outcome of a race, competition or other event or process, or \line (ii) the likelihood of anything occurring or not occurring; \line (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner. \par \pard\ltrpar\nowidctlpar\par \pard\ltrpar\nowidctlpar\fi-720\li720\b 4.\b0\tab The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).\par \b 5.\b0\tab The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.\par \b 6.\b0\tab The premises licence holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.\par \pard\ltrpar\nowidctlpar\li720 The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.\par \pard\ltrpar\nowidctlpar\b 7.\b0\tab The responsible person shall ensure that-\par \pard\ltrpar\nowidctlpar\li1440 (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures- \par \pard\ltrpar\nowidctlpar\li1440\tx1080 (i) beer or cider: \'bd pint; \line (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and \line (iii) still wine in a glass: 125 ml; and \line\par \pard\ltrpar\nowidctlpar\fi720\li720 (b) customers are made aware of the availability of these measures. \par \pard\ltrpar\nowidctlpar\par \pard\cbpat1\ltrpar\nowidctlpar\fi-720\li720\qj\b 8\b0 .\tab A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. \par \pard\cbpat1\ltrpar\nowidctlpar\fi720\qj\par For the purposes of the condition set out in charged on the date of the sale or supply of the alcohol; \par \pard\cbpat1\ltrpar\nowidctlpar\fi-709\li709 (c)\tab \ldblquote relevant person\rdblquote means, in relation to premises in respect of which there is in force a premises licence- \par \pard\cbpat1\ltrpar\nowidctlpar\fi-720\li1440 (i)\tab the holder of the premises licence, \par (ii)\tab the designated premises supervisor (if any) in respect of such a licence, or \par (iii) \tab the personal licence holder who makes or authorises a supply of alcohol under such a licence; \par \pard\cbpat1\ltrpar\nowidctlpar\fi-720\li720 (d) \ldblquote relevant person\rdblquote means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and \par (e)\tab \ldblquote valued added tax\rdblquote means value added tax charged in accordance with the Value Added Tax Act 1994. \par \pard\cbpat1\ltrpar\nowidctlpar\par \pard\cbpat1\ltrpar\nowidctlpar\fi-720\li720\qj\b 9.\b0 \tab Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. \par \par \pard\cbpat1\ltrpar\nowidctlpar\fi-1418\li1418\qj\b 10.\b0 (1) \tab Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (\ldblquote the first day\rdblquote ) would be different from the permitted price on the next day (\ldblquote the second day\rdblquote ) as a result of a change to the rate of duty or value added tax. \par Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, the licence must include a condition that each individual must be licensed by the Security Industry\par \par \par \b Annex 2\tab\tab Conditions consistent with operating schedule\par \b0\par \b Prevention of Crime and Disorder\par \b0\par \pard\ltrpar\nowidctlpar\fi-709\li709\b 1\tab\b0 The licence holder shall ensure security staff will be on site from 11am until 12pm. \par \pard\ltrpar\nowidctlpar\par \pard\ltrpar\nowidctlpar\fi-709\li709\b 2\tab\b0 The licence holder shall ensure the use of SIA registered security for the event.\par \pard\ltrpar\nowidctlpar\par \pard\ltrpar\nowidctlpar\fi-709\li709\b 3\tab\b0 The licence holder shall ensure that the event staff are vigilant for any behaviours not suitable at a family event [i.e. attempted drug use, foul language and/or aggressive behaviour]. Any signs of unlawful activity will result in ejection from the site and the Police being contacted. \par \b\par 4\tab\b0 The licence holder shall ensure that all Drinks are to be provided in plastic/polycarbonate drinking vessels.\par \par \b 5\tab\b0 The licence holder shall ensure \lquote Think 25\rquote is to be employed by bar company and event staff with reasonable limits enforced to restrict sale if customers have had too much alcohol.\par \par \par \pard\ltrpar\nowidctlpar\b Public Safety\par \b0\par \pard\ltrpar\nowidctlpar\fi-709\li709\b 6\tab\b0 The licence holder shall ensure an evacuation plan and meet points are available in case of emergency. \par \pard\ltrpar\nowidctlpar\li709\par \pard\ltrpar\nowidctlpar\fi-705\li709\b 7\tab\b0 The licence holder shall ensure all prominent poles from marquees are covered with soft foam and marked clearly. \par \b\par 8\tab\b0 The licence holder shall ensure there are 2 access points to the site to allow flow of traffic and safe pedestrian access.\par \b\par 9\tab\b0 The licence holder shall ensure security staff and St. Johns Ambulance staff are on site throughout the entire day.\par \pard\ltrpar\nowidctlpar\par \b Prevention of Public Nuisance\par \b0\par \pard\ltrpar\nowidctlpar\fi-709\li709\b 10\tab\b0 The licence holder shall ensure that all customers will be permitted to drink alcohol on site only with alcohol purchased from the site.\par \par \b 11\tab\b0 The licence holder shall ensure all live/recorded music is to be played away from any housing and at a reasonable level.\par \b\par \pard\ltrpar\nowidctlpar\fi-709\li709\sa200\sl276\slmult1 12\tab\b0 The licence holder shall ensure the Police are notified of any disturbance that may cause public nuisance and all customers are asked to leave the site quietly after the event to avoid any disturbance to the local community.\par \pard\ltrpar\nowidctlpar\fi-709\li709\b 13\tab\b0 The licence holder shall ensure that in order to protect nearby residents on the 11th and 12th July the setting up of the event; all vehicle movement will be kept to an absolute minimum. Deliveries must be made between 8am and 11am and after this time there will be no vehicle movement on site. \par \par \b 14\tab\b0 The licence holder shall ensure that no access or egress is to be used on the Rycroft Road entrance to the field in order to protect the amenity of domestic properties residents who live down the side of the lane to the field. This is to be monitored at all times during the event by a minimum of 2 staff to ensure that no one uses this for entry or exit.\par \par \b 15\tab\b0 The licence holder shall ensure that the speakers and the main tent are to be positioned on the bottom field down the embankment. Speakers are to face in the opposite direction facing away from residential properties.\par \par \b 16\tab\b0 The licence holder shall ensure that the Coronation Road entrance and exit must be monitored at all times next to domestic properties to ensure that people entering and leaving the site cause no anti-social behaviour and noise is kept to a minimum to respect the privacy of people living in properties on Coronation Road and Ryecroft Road.\par \par \b 17\tab\b0 The licence holder shall ensure that all roads and public highways around the site must be cleared of any rubbish, bottles, plastic, glasses etc. A no glass policy must be in place.\par \par \b 18\tab\b0 The licence holder shall ensure that all refuse must be placed in the correct receptacles provided. Refuse and contaminated liquids will be disposed of responsibly in the trader\rquote s facility area. No LPG bottles and oil drums are to be left on site.\par \par \b 19\tab\b0 The licence holder shall ensure that there are to be no animals allowed on site.\par \par \b 20\tab\b0 The licence holder shall ensure that all marquees, tents or other self-build structures should be of sound construction including all supporting poles, frames , guy-ropes, stakes/anchors and fastenings ect. and all guy-ropes and fixing stays shall be conspicuously marked to ensure they do not present a trip hazard. Gazebos are not suitable for trading as they are likely to be blown away even by light winds.\par \par \b 21\tab\b0 The licence holder shall ensure that they do not sell drinks in glass containers; the whole site has a no glass policy.\par \par \b 22\tab\b0 The licence holder shall ensure that all amplified music in an outside marquee or in the open air shall finish no later than 23:00 hours.\par \par \b 23\tab\b0 The licence holder shall ensure that rehearsals and sound checks are permitted only between the following hours of 11:00 hours to 23:00 hours.\par \par \b 24\tab\b0 The licence holder shall ensure that music from the concert or event is permitted only between the following hours 12:00 hours to 23:00 hours.\par \par \b 25\tab\b0 The licence holder shall ensure that the site must be cleared by 00:00 hours [midnight].\par \par \b 26\tab\b0 The licence holder shall ensure that music from other sources [e.g. food traders, etc.] is permitted only between the following hours of 12:00 hours and 23:00 hours.\par \par \b 27\tab\b0 The licence holder shall ensure that the control limits set at the mixer position shall be adequate to ensure that the music noise level shall not at any noise sensitive premises exceed 75dB(A) over a fifteen minute period / the background noise level by 15dB(A) over a fifteen minute period throughout the duration of the concert or event.\par \par \b 28\tab\b0 The licence holder shall ensure that the control limits set at the mixer position shall be adequate to ensure that the music noise level shall not at any noise sensitive premises exceed 75dB(A) over a fifteen minute period / the background noise level by 15dB(A) over a fifteen minute period throughout the duration of any rehearsal or sound check for the concert or event.\par \par \par \b 29\tab\b0 The event organiser shall have full control over the sound amplification equipment and the volume shall be adjusted according to the requirements of the Responsible Authority for Environmental Health [Environmental Protection].\par \par \b 30\tab\b0 The event organiser shall ensure that all persons [including individual sound engineers] involved with the sound system are informed of the sound control limits and that any instructions from the Responsible Authorities for Environmental Health [Environmental Protection] regarding noise levels are complied with.\par \par \b 31\tab\b0 The licence holder shall ensure that unrestricted access to the front of house position and backstage areas shall be allowed at all times to the Responsible Authorities for Environmental Health [Environmental Protection] for the purpose of sound level measurements, communications with the nominated noise consultant/sound engineer and for monitoring licence conditions.\par \par \b 32\tab\b0 The licence holder shall ensure that all complaints about noise received by the site office/event organiser shall be logged and shall be notified to the Responsible Authorities for Environmental Health [Environmental Protection] within 30 minutes of the complaint being received by ringing the "out of hours" noise team on 07717 451148.\par \par \b 33\tab\b0 The event organiser shall effect full control over traders or other organisations on site where there is amplified music being played. At the request of the Responsible Authorities for Environmental Health [Environmental Protection] the event organiser shall arrange for the volume to be reduced as directed by the out of hours noise team.\par \par \par \pard\ltrpar\nowidctlpar\b Protection of Children from Harm\par \b0\par \pard\ltrpar\nowidctlpar\fi-709\li709\b 34\tab\b0 The licence holder shall ensure the Challenge 25 scheme will operate at all times when the premises are open, including a refusals log, signage and the maintenance of staff training records.\par \par \b 35\tab\b0 The licence holder shall ensure all children under 16 years of age are to be accompanied by a responsible adult at all times.\par \par \b 36\tab\b0 The licence holder shall ensure members of volunteer staff are safeguarding trained.\par \par \pard\ltrpar\nowidctlpar\fi-709\li709\sa200\sl276\slmult1\b 37\tab\b0 The licence holder shall ensure Training records shall be kept of all staff employed and concerned with the sale and supply of alcohol and open to inspection by Responsible Authorities.\par \pard\ltrpar\nowidctlpar\par \b Annex 3\tab Conditions attached after a Hearing of Licensing Authority\par \b0\par None.\par \par \b Annex 4\tab Plans\par \b0\par See attached.\par \par \par } "
