and\par \pard\ltrpar\nowidctlpar\fi-357\li1434\sa200\sl276\slmult1\fs24 (iii)\tab\fs22 still wine in a glass: 125 ml; and\par \pard\ltrpar\nowidctlpar\fi-567\li993\sa200\sl276\slmult1\tx993 (b)\tab these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and \par (c)\tab where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.\par \pard\ltrpar\nowidctlpar\sa200\sl276\slmult1\b Minimum Drinks Pricing\par \pard\ltrpar\nowidctlpar\fi-709\li709\sa200\sl276\slmult1\b0 1.\tab A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.\par 2.\tab For the purposes of the condition set out in paragraph 1 -\par \pard\ltrpar\nowidctlpar\fi-360\li720\sa200\sl276\slmult1 (a)\tab\ldblquote duty\rdblquote is to be construed in accordance with the Alcoholic Liquor Duties Act 1979\par (b)\tab\ldblquote permitted price\rdblquote is the price found by applying the formula - \par \pard\ltrpar\nowidctlpar\li720\sa200\sl276\slmult1 P = D + (DxV)\par \pard\ltrpar\nowidctlpar\li426\sa200\sl276\slmult1\tx426 Where - \par (i) P is the permitted price\par \pard\ltrpar\nowidctlpar\li709\sa200\sl276\slmult1\tx426\tx720\fs24 (ii)\tab\fs22 D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and \par \pard\ltrpar\nowidctlpar\li709\sa200\sl276\slmult1\fs24 (iii)\tab\fs22 V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;\par \pard\ltrpar\nowidctlpar\fi-360\li720\sa200\sl276\slmult1 (c)\tab\ldblquote relevant person\rdblquote means, in relation to premises in respect of which there is in force a premises licence - \par \pard\ltrpar\nowidctlpar\fi-720\li1800\sa200\sl276\slmult1\tx1800 (i)\tab The holder of the premises licence\par \pard\ltrpar\nowidctlpar\fi-720\li1800\sa200\sl276\slmult1 (ii)\tab The designated premises supervisor (if any) in respect of such a licence, or\par (iii)\tab The personal licence holder who makes or authorises a supply of alcohol under such a licence;\par \pard\ltrpar\nowidctlpar\fi-360\li720\sa200\sl276\slmult1 (d)\tab\ldblquote relevant person\rdblquote means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and\par (e)\tab\ldblquote value added tax\rdblquote means value added tax charged in accordance with the Value Added Tax Act 1994.\par \pard\ltrpar\nowidctlpar\fi-720\li1080\sa200\sl276\slmult1\tx1080 3.\tab Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from the paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.\par \pard\ltrpar\nowidctlpar\fi-720\li1080\sa200\sl276\slmult1 4.\tab (1)\tab Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (\ldblquote the first day\rdblquote ) would be different from the permitted price on the next day (\ldblquote the second day\rdblquote ) as a result of a change to the rate of duty or value added tax.\par \pard\ltrpar\nowidctlpar\li1080\sa200\sl276\slmult1 (2)\tab The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.\b\par \pard\ltrpar\nowidctlpar\par If the Premises Licence has conditions in respect of Door Supervision\par [except theatres, cinemas, bingo halls and casinos]\par \pard\ltrpar\nowidctlpar\fi-567\li567\sa200\sl276\slmult1\b0\f1\par \f0 1.\tab Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, each such individual must:\par (a)\tab be authorised to carry out that activity by a licence granted under the Private Security Industry Act 2001; or\par \pard\ltrpar\nowidctlpar\sa200\sl276\slmult1 (b)\tab be entitled to carry out that activity by virtue of section 4 of the Act.\par 2.\tab But nothing in subsection (1) requires such a condition to be imposed:\par \pard\ltrpar\nowidctlpar\fi-709\li709\sa200\sl276\slmult1 (a)\tab in respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Act 2001 (c12) (premises with premises licences authorising plays or films); or\par \pard\ltrpar\nowidctlpar\sa200\sl276\slmult1 (b)\tab in respect of premises in relation to:\par \pard\ltrpar\nowidctlpar\fi-414\li1134\sa200\sl276\slmult1 (i)\tab any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence), or\par \pard\ltrpar\nowidctlpar\fi-425\li1134\sa200\sl276\slmult1\tx1134 (ii)\tab any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act.\par \pard\ltrpar\nowidctlpar\sa200\sl276\slmult1 3.\tab For the purposes of this section:\par \pard\ltrpar\nowidctlpar\fi-709\li709\sa200\sl276\slmult1 (a)\tab\ldblquote security activity\rdblquote means an activity to which paragraph 2(1)(a) of that Schedule applies, and, which is licensable conduct for the purposes of that Act, (see Section 3(2) of that Act) and \par \pard\ltrpar (b)\tab paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.\par \par \pard\ltrpar\keepn\nowidctlpar\s1\qj\b Annex 2\tab\tab Conditions consistent with operating schedule\par \pard\ltrpar\nowidctlpar\fi-720\li1440\qj\par \pard\ltrpar\nowidctlpar\qj Prevention of Crime and Disorder\par \par \pard\ltrpar\nowidctlpar\fi-720\li720\qj\tx720\b0 1.\tab The licence holder shall ensure that staff have appropriate training in dealing with problem customers. \par \pard\ltrpar\nowidctlpar\qj\b\par \pard\ltrpar\nowidctlpar\fi-1080\li1080\qj\tx720\b0 2.\tab The licence holder shall become a member of Rotherham Pub and Club Watch. \par \pard\ltrpar\nowidctlpar\qj\par \b Public Safety\par \b0\par \pard\ltrpar\nowidctlpar\fi-720\li720\qj\tx720 3.\tab The licence holder shall ensure that staff have appropriate training to secure the safety of the premises and its patrons.\par \pard\ltrpar\nowidctlpar\qj\par \pard\ltrpar\nowidctlpar\fi-720\li720\qj\tx720 4.\tab The licence holder shall ensure that potentially dangerous items such as glass containers/bottles are stored safely and are not within easy reach of customers.\par \pard\ltrpar\nowidctlpar\qj\par \par \pard\ltrpar\nowidctlpar\fi-720\li720\qj\tx720 5.\tab The licence holder shall ensure that regular testing (and certification where appropriate) e.g. fire equipment, procedures, appliances, systems etc pertinent to safety.\par \pard\ltrpar\nowidctlpar\qj\par \b Prevention of Public Nuisance\par \b0\par \pard\ltrpar\nowidctlpar\fi-720\li720\qj\tx720 6\tab The licence holder shall ensure that customers are asked to respect the need to arrive and leave the premises quietly.\par \pard\ltrpar\nowidctlpar\qj\par \pard\ltrpar\nowidctlpar\fi-720\li720\qj 7\tab The licence holder shall ensure that regular/daily checks for litter outside the premises are undertaken.\par \pard\ltrpar\nowidctlpar\qj\par \b Protection of Children from Harm\par \b0\par None.\par \pard\ltrpar\keepn\nowidctlpar\s1\qj\b\par \pard\ltrpar\nowidctlpar Annex 3\tab Conditions attached after a Hearing of Licensing Authority\par \b0\par None.\par \par \b Annex 4\tab Plans\par \b0\par See attached.\par \par \par \par \par \par \par \fs24\par \pard\ltrpar\f2\fs16\par } "
