Annex 1 Mandatory Conditions
Mandatory conditions where licence authorises supply of alcohol
1 No supply of alcohol may be made under the premises licence:-
a at a time when there is no designated premises supervisor in respect of the premises licence,
or
b at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
2 Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3 The responsible person will take all reasonable steps to ensure that that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. The premises licence holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
7. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2 Conditions consistent with Operating Schedule
Prevention of Crime and Disorder
1. The licence holder will become a member of a Licensees' Association or other licensees representative body, such as 'Licence watch.' recognised by South Yorkshire Police.
Management Controls
2 The licence holder shall ensure all staff will be suitably trained for their job function in the operating standards for the premises. The training shall be under constant review having regard to newly employed staff.
3 The licence holder shall ensure all staff will are fully trained to perform their role. They will also be trained in the contents of the premises licence including times of operation, licensable activities and all conditions.
4 The licence holder shall ensure that the training is recorded in documentary form that will be available for inspection at the request at all reasonable times by an authorised officer from a relevant responsible authority. The records will be retained for at least 12 months.
5 The licence holder shall ensure that any person managing or supervising staff in the sale of alcohol or other licensable activity in the absence of the DPS will be the holder of a personal licence obtained from a nationally recognised body.
6 The licence holder shall ensure all staff are trained in the requirements of "Challenge 21"
7 The licence holder shall maintain an incident book which will be maintained to record any activity of a violent, criminal or antisocial nature, The record will contain the time and date, the nature of the incident, the people involved, the action taken and details of the person responsible for the management of the premises at the time of the incident.
8 The licence holder shall ensure that the incident book will be available for inspection at all reasonable times by an authorised officer of relevant responsible authority. The records will be retained for at least 12 months.
9 The licence holder shall ensure all staff are suitably trained in the operating procedures for refusing service to any person who is drunk or is under-age or appears to be under-age. There shall be no admissions or re-admission to the premises after 20.00 hours.
9 The licence holder shall ensure that Spirits and all alcoholic beverages on display will be in such a position so as not to be obscured from the constant view of the cashier staff. (If this is not reasonably practical the Licensing Authority shall be consulted regarding other suitable locations in the premises).
Glassware & Bottles
10 The licence holder shall ensure that except for the sale of a bottle of wine for consumption with a meal in a designated area of the premises, no bottles containing beverages of any kind, whether open or sealed, will be given to customers on the premises whether at the bar or by staff service away from the bar.
11 The licence holder shall ensure that all drinks are served in plastic/paper/ toughened glass or polycarbonate containers.
12 The licence holder shall ensure that all drinks are served in plastic/paper/ toughened glass or polycarbonate containers for customers using specified areas inside and outside the premises.
13 The licence holder shall ensure that the collection of glasses and bottles will be undertaken at regular intervals to ensure there is no build-up of empties in and around the premises.
Restrictions on Drinking Areas
14 The licence Holder and/or Designated Premises Supervisor will ensure that any outside area included in the licence will be controlled in a safe and effective manner to the same standard operated within the premises building and will pay special attention to the impact that the use of the outside area has on the surrounding community.
Substance misuse
15 The licence holder or nominated person will provide a written drugs policy detailing the actions to be undertaken to minimize the opportunity to use or supply illegal substances within the premises.
16 The licence holder or nominated person will ensure that records are maintained detailing the time and date of substance misuse training, the people who received the training, and the name of the person delivering the training. The records will be available for inspection by an authorised officer at all reasonable times. The records will be retained for at least 12 months.
17 The licence holder or nominated person will ensure that a senior member of the management team at the premises holds a National Certificate of Drugs Awareness qualification, run by the BlI or similar accredited body.
18 The licence holder or nominated person will deliver a structured training programme at (regular intervals) to all staff that deal with persons who are in the possession of / or incapacitated through the use of drugs or the combined effect of drugs and alcohol.
19 The licence holder or nominated person will ensure that a clearly visible notice is displayed advising those attending, that the Police will be informed if anyone is found in possession of controlled substances.
20 The licence holder or nominated person will ensure that security arrangements are in place where toilet areas and other similar areas are regularly checked for evidence of drugs. The date and times of all checks to be recorded in a bound book kept for that purpose and be available on request from an authorised officer of the Licensing Authority or a police constable. Signage will also be placed in the toilet areas advising patrons that checks are conducted regularly.
Public Safety
22 The licence holder shall ensure that doors fitted with automatic door-closers will be maintained in good working order. The licence holder will nominate a senior member of staff as the person responsible for the management, supervision, compliance with licensing conditions.
23 The licence holder shall ensure that any moveable furniture will be fitted with rubber (or equivalent) feet.
Prevention of Public Nuisance
Noise Precautions
24 The licence holder or nominated person will ensure that during the final hour of trading appropriate announcements are made to remind patrons of the need to leave the premises quietly without causing annoyance, nuisance or disturbance to local residents.
25 The licence holder shall ensure that no speakers for amplification of music shall be placed on the outside of the premises or on the outside of any building forming a part of the premises.
26 The licence holder shall ensure that no music or speech shall be relayed via external speakers other than for events where the prior approval of the licensing authority has been obtained.
External Area Controls
27 The licence holder or nominated person will erect and maintain suitable and sufficient conspicuous signage on the exterior of the premises advising patrons that causing any disturbance or disorder will result in admission being refused.
28 The licence holder or nominated person shall arrange supervision of any queue which may form to gain entry to the premises.
29 The licence holder or nominated person will erect and maintain, in a prominent position at each exit a clear, conspicuous and legible notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents.
30 The licence holder shall ensure that a designated, de-lineated and bordered smoking area will be allocated outside the premises. Suitable receptacles will be provided for cigarette litter within the designated smoking area.
31 The licence holder shall ensure that there will' be no consumption of beverages in any outside areas/specific after 20.00 hours.
32 The licence holder shall ensure that any outdoor areas to the front the premises will not be used by customers or staff after 20.00 hours.
33 The licence holder shall ensure that the outdoor seating will only be open to customers Monday to Sunday from 9.00am until 20.00. Notices shall be displayed in appropriate locations to ensure that this information is brought to the attention of patrons.
34 The licence holder shall ensure all outside areas will be closed and cleared of customers by 20.00 hours. Adequate notices shall be displayed to inform patrons of this requirement.
35 The licence holder shall ensure that where patrons are allowed to use the area for smoking the area will be provided with suitable ashtrays/bins,
36 The licence holder shall ensure that smoking area is regularly swept to remove cigarette ends
37 The licence holder shall ensure that after 19.30 hours no drinks will be allowed to be taken outside to the outside area and no consumption of drinks to occur after 20.00 hours.
38 The licence holder shall ensure that a sign will be placed in the outside rear area specifying that no drinks are to be taken into this area after 19.30 hours.
39 The licence holder shall ensure that after 19.00 hours noise levels in outside areas will be monitored and controlled to minimise any potential impact on local residents.
40 The licence holder shall ensure that after 18.30 hours the capacity in the outside rear area will be limited to 16 persons.
41 The licence holder or nominated person will ensure that the smoking area is regularly cleaned to ensure that all discarded smoking lifter is removed and properly disposed.
42 The licence holder shall ensure that the outside seating area will be limited to a maximum of 18 persons at any one time.
Protection of Children from Harm
43 The licence holder will provide an appropriate environment and adequate facilities for children to a standard which is acceptable to Rotherham's child protection committee.
Proof of Age Scheme
44 The licence holder and/or Designated Premises Supervisor will ensure that all bar staff, are trained in the legality and procedure of alcohol sales, prior to undertaking the sale of alcohol and then at least every six months. Training shall be signed and documented and training records will be kept on the premises and be made available to an enforcement officer on request. The documentation relating to training should extend back to a period of three years and should specify the time, date and details of the persons both providing the training and receiving the training.
45 The licence holder and/or Designated Premises Supervisor will ensure a sales refusal register is maintained to include details of all alcohol sales refused and the reason for refusal. The refusals register should be made available to an authorized enforcement officer on request.
46 The licence holder shall ensure a till prompt system will be installed to assist staff by reminding them to challenge for ID when a sale is made.
47 The licence Holder and/or Designated Premises Supervisor will have a written age verification policy in relation to the sale or supply of alcohol. This policy will include documented steps taken to prevent adults from purchasing alcohol for or on behalf of children under 18s and will specify a Challenge 25 proof of age requirement before sales of alcohol are made.
48 The Licence Holder and/or Designated Premises Supervisor will ensure that new bar staff, supervisors and managers receive induction in the legality and procedure of alcohol sales, prior to undertaking the sale of alcohol. Training shall be signed and documented and training records be made available to an enforcement officer on request.
