Mandatory Conditions
The following mandatory conditions will apply:
1. No supply of alcohol may be made under the premises licence:
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence, or their personal licence is suspended.
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The premises licence holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
4. The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
5. The age verification policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either:-
(a) a holographic mark: or
(b) an ultraviolet feature.
6. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price, which is less than the permitted price.
7. For the purpose of the condition 6 above:
(a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979(6).
(b) “permitted price” is the price found by applying the formula:- P = D + (D x V) where:-
(i) P is the permitted price,
(ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol.
(c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence:-
(i) the holder of the premises licence
(ii) the designated premises supervisor (if any) in respect of such a licence, or
(iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence.
(d) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994(7).
8. Where the permitted price given by Condition 7(b) would (apart from this paragraph) not be a whole number of pennies, the price given shall be taken to be the price actually rounded up to the nearest penny.
9. Where the permitted price given by Condition 7(b) on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax, the permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14
Annex 2 Conditions consistent with operating schedule
1. The Premises will operate as a Motorway Service Area with associated facilities.
2. The provision of licensable activities will be limited to those areas as shown on plans attached at Annex 4 to this Licence.
3. Any detail shown on the plans attached at Annex 4 to this Licence that is not required by the licensing plans regulations is indicative only and subject to change at any time.
4. Locations of fire safety equipment and other safety equipment subject to change in accordance with the requirements of the Responsible Authorities or following a risk assessment.
5. All sales of alcohol for consumption off the premises shall be in sealed containers only and shall not be consumed on the premises.
6. Measures will be in place for the safe evacuation of persons with disabilities in case of fire or emergency.
7. The Premises shall maintain a Fire Risk Assessment to be kept on the premises and made available for inspection by the responsible authorities on request.
8. All members of staff shall be fully trained commensurate with their duties in the retail sale of alcohol; and such training shall be ongoing, and each member of staff shall be reviewed every six months.
9. Staff training provided shall be recorded in a bound and sequentially paginated book, or electronic record, and such records shall be retained at the premises for at least 12 months. This record shall be made available for inspection and copying by the Police or any other authorised person on request and all such books.
10. A CCTV system shall be installed and operative in the premises when licensable activities are taking place.
11. All recordings used in conjunction with the CCTV system shall:
(a) be of evidential quality;
(b) indicate the correct time and date;
(c) be retained for a period of 31 days; and
(d) cover the point of sale, and entry and exit, as a minimum
12. At least one person trained and authorised to access the CCTV system shall be present during opening hours. They shall be able to perform basic operations such as reviewing and downloading recordings to removable media if required for Police or other authorised officers.
13. CCTV Recordings to be made available for inspection to the Police or any other authorised person when requested
14. A bound and sequentially paginated incident book, or electronic record, shall be kept in which all instances of disorder, damage to property and personal injury at the premises shall be recorded. This record shall be made available for inspection and copying by the Police or any other authorised person upon request and all such records shall be retained at the premises for at least 12 months.
15. A Challenge 25 scheme shall operate at the premises. Under this scheme any person who appears to be under 25 years of age shall not be allowed to purchase alcohol unless they produce valid identification. Valid identification is limited to:
(a) Passport
(b) Photo Driving Licence
(c) Military ID
(d) PASS Accredited Holographic Proof of Age Card
(e) National, including EU, Identity Card
16. A till prompt will be installed which will ask for a staff member to confirm they have checked the purchasers age fin respect of age restricted products
17. A bound and sequentially paginated refusals book, or electronic record, shall be kept in which all instances where the service of alcohol is refused shall be reordered. This record shall show the:
(a) basis for the refusal;
(b) name of the person who made the decision to refuse the sale; and
(c) date and time of the refusal.
18. Alcohol refusal records shall be retained at the premises for at least 12 months and shall be made available for inspection and copying by the Police or any other authorised person upon request.
19. Challenge 25 notices advising customers that they may be asked to provide evidence of age shall be displayed in prominent positions throughout the premises, including at points of sale.
20. All displays of alcohol will be appropriately ticketed to advise purchasers that it is an offence for those under 18 to purchase alcohol.
