Annex 1 - Mandatory Conditions
Supply of alcohol (where permitted by the licence):
1. No supply of alcohol may be made under the premises licence:
at a time when there is no designated premises supervisor in respect of the premises licence, or
at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Door supervision:
3. Where employed each such individual must be licensed by the Security Industry Authority.
Irresponsible Promotions:
4. The responsible person must ensure that the staff do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. An irresponsible promotion is one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises:
Provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective.
Provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective.
Free drinking water (potable water):
5. Free potable water must be provided on request to customers where it is reasonably available on the premises.
Age verification:
6. An age verification policy for the premises must be produced, implemented and details made available to authorised officers upon request. The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
7. The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either:
a holographic mark, or
an ultraviolet feature
Small alcohol measures:
8. The responsible person must ensure that where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container). It is available to customers in the following measures:
beer or cider: ½ pint
gin, rum, vodka or whisky: 25 ml or 35 ml, and
still wine in a glass: 125 ml
9. These measures must be displayed in a menu, price list or other printed material which is available to customers on the premises. Customers must be made aware that these measures are available.
Permitted price:
10. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. For the purposes of the condition 'duty' is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;
'permitted price' is the price found by applying the formula: P = D + (D x V) where:
P = the permitted price
D = the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol
V = the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol
'Relevant person' means, in relation to premises in respect of which there is in force a premises licence:
The holder of the premises licence
The designated premises supervisor (if any) in respect of such a licence, or
The personal licence holder who makes or authorises a supply of alcohol under such a licence
Annex 2 - Conditions consistent with the Operating Schedule
1. The store shall not be open to the public beyond 11pm, any sales of alcohol between the hours 11pm and 7am daily shall be for online delivery fulfilment only.
2. The premises shall maintain a CCTV system which gives coverage of all entry and exit points. This system shall continuously record whilst the premises are open to the public and conducting licensable activities.
3. All CCTV recordings shall be stored for a minimum period of 31 days and shall be capable of being easily downloaded.
4. CCTV recordings shall be made available upon the receipt of a request by an authorised Officer of the Police or the local Authority.
5. There shall be 'CCTV in operation' signs prominently displayed in the premises.
6. An incident log (whether kept in written or electronic form) shall be retained at the premises and made available for inspection by an authorised Officer of the Police or the Local Authority.
7. The premises shall operate a proof of age scheme, such as Challenge 25, whereby the only forms of acceptable identification shall be a photographic driving licence, valid passport, military identification or any other recognised form of photographic identification incorporating the PASS logo, or any other form of identification from time to time approved by the Secretary Of State.
8. All relevant staff will receive training in relation to the sale of alcohol upon their induction with the company. No member of staff will be permitted to sell alcohol until such time as they have successfully completed the training. Refresher training will be provided to all relevant staff members, such training to be provided at intervals of not more than 6 months.
9. A till prompt system will be utilised at the premises in respect of alcohol.
10. A refusals register (whether kept in written or electronic form) will be maintained at the premises and will be made available for inspection by an authorised Officer of the Police or the Local Authority.
11. Deliveries of Alcohol
a) The delivery of alcohol is to be made only to a residential or business address, where the customer is a resident or occupies the business. The delivery of alcohol shall not be made to a person in a public place such as a street corner, park or bus stop etc.
b) If any third-party delivery services are used at the premises, all the waiting drivers shall be told to switch off their engines and minimise noise and nuisance to not cause any disturbance to nearby businesses and residents and a notice to this effect shall be placed in the prominent place which shall be easily seen by the drivers.
c) Age verification will be made (using Challenge 25) when orders containing alcohol are being delivered (no ID no delivery) - acceptable proof of age shall include identification bearing the customer’s photograph, date of birth and integral holographic mark or other approved security feature.
12. The premises will be fitted with a burglar alarm system; and a panic button system for staff to utilise in the case of an emergency.
13. The Licence Holder shall ensure that the appropriate fire safety, and health and safety regulations are applied at the premises.
14. A complaints procedure shall be in operation at the premises, details of which will be made available in store.
