Annex 1 - Mandatory Conditions
Supply of alcohol (where permitted by the licence):
1. No supply of alcohol may be made under the premises licence:
at a time when there is no designated premises supervisor in respect of the premises licence, or
at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Door supervision:
3. Where employed each such individual must be licensed by the Security Industry Authority.
Irresponsible Promotions:
4. The responsible person must ensure that the staff do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. An irresponsible promotion is one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises:
Provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective.
Provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective.
Free drinking water (potable water):
5. Free potable water must be provided on request to customers where it is reasonably available on the premises.
Age verification:
6. An age verification policy for the premises must be produced, implemented and details made available to authorised officers upon request. The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
7. The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either:
a holographic mark, or
an ultraviolet feature
Small alcohol measures:
8. The responsible person must ensure that where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container). It is available to customers in the following measures:
beer or cider: ½ pint
gin, rum, vodka or whisky: 25 ml or 35 ml, and
still wine in a glass: 125 ml
9. These measures must be displayed in a menu, price list or other printed material which is available to customers on the premises. Customers must be made aware that these measures are available.
Permitted price:
10. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. For the purposes of the condition 'duty' is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;
'permitted price' is the price found by applying the formula: P = D + (D x V) where:
P = the permitted price
D = the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol
V = the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol
'Relevant person' means, in relation to premises in respect of which there is in force a premises licence:
The holder of the premises licence
The designated premises supervisor (if any) in respect of such a licence, or
The personal licence holder who makes or authorises a supply of alcohol under such a licence
Exhibition of films:
11. No film shall be exhibited unless it has received a 'U', 'PG', '12A', '15' or '18' certificate from the British Board of Film Censors, the British Board of Film Classification (BBFC) or has been approved, in writing, by the licensing authority.
12. Where a programme includes a film in an age limited category, no person appearing to be under that age shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms:
PERSONS UNDER THE AGE OF (INSERT APPROPRIATE AGE) CANNNOT BE ADMITTED TO ANY PART OF THE PROGRAMME
13. Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction. This condition does not apply to members of staff under the relevant age while on duty provided that the prior written consent of the person’s parents or legal guardian has first been obtained.
Annex 2 - Conditions consistent with the Operating Schedule
1. The DPS, or a duty manager trained on the management controls set out in this licence, shall be on duty during the provision of licensable activities.
2. During the day time provision of licensable activities the DPS, or duty manager, shall be in radio communication with the onsite life saver. At all other times that licensable activities are being provided a member of staff trained in water safety awareness and throw line rescue shall be on duty.
3. A CCTV system shall be fitted, maintained, and in use at all times whilst the premises are open. Note: CCTV systems installed after 2021 should be full digital systems with wide dynamic range IP cameras (WDR).
a. CCTV footage shall:
b. show the correct time and date;
c. be retained for a minimum of 30 days; and
d. be kept in a secure environment so as to prevent tampering or unauthorised viewing.
4. Members of the management team shall be trained in the use of the CCTV system; and a record kept of the name, date, time and reason of any person who accesses the CCTV
5. The Police and/or an authorised officer of the Licernsing Authority shall be given access to CCTV images for purposes in connection with the prevention and detection of crime and disorder, in line with GDPR guidance.
6. A Challenge 25 Policy shall be in operated. This Policy shall require any person who appears to be under the age of 25 to provide ID prior to being served alcohol. Acceptable forms of ID are a:
a. passport;
b. UK photo driving licence; or
c. military ID card.
7. All challenges made under the Challenge 25 Policy shall be logged in a bound book. This log must show:
a. date of the challenge was made;
b. member of staff who made the challenge; and
c. if allowed, the type of id accepted
8. Signs shall be displayed inside the premises that advertise that the premises operates “Challenge 25”.
9. A bound incident book shall be maintained, in which the following shall be recorded:
a. All incidents of crime and disorder occurring at the premises; and
b. Details of when the Police are called.
10. The Challenge 25 log and the incident book shall be kept on the premises and shall be available for inspection upon request by the Police or an authorised officer of the Licensing Authority.
11. The DPS, or their nominated deputy, shall check the Challenge 25 log and the incident book at least once a week, and sign and date each check.
12. It is considered that for the day to day operation of the premises door supervisors will not be required. However, the use of door supervisors for non-standards events will be risk assessed and where employed must be door staff shall be licensed by the SIA.
13. It is considered that for the day to day operation of the premises plastic/polycarbonate drinking vessels will not be required. However, the use of plastic/polycarbonate drinking vessels for non-standards events will be risk assessed and where identified as necessary shall be provided.
14. A written record of all risk assessments undertaken shall be kept at the premises for a minimum of 6 months and made available to the Police or an Officer of the Licensing Authority upon request
15. A zero drugs policy shall be in operation at the premises .
16. Other than the day time operation of the premises, that is when the premises are providing licensable activities beyond 7pm children must be accompanied by a responsible adult.
17. No adult entertainment or services shall be provided at the premises.
18. All staff shall receive training on induction and at least each year thereafter, on:
a. vulnerability awareness;
b. operation of the 'Challenge 25'Policy, including types of acceptable ID and the method of recording challenges;
c. refusing sales of alcohol to persons who appear to be drunk;
d. preventing proxy sales:
e. incident recording and when to call the Police;
19. Staff training shall be recorded, records shall be kept of the premises and shall, on request, be made available for inspection by the Police or an authorised officer of the Licensing Authority.
