  Mandatory conditions where licence authorises supply of alcohol

   

  1              No supply of alcohol may be made under the premises licence:-

               

                a              at a time when there is no designated premises supervisor in respect of the premises licence,

  or

                b              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

  The Prevention of Public Nuisance

   

  1              The licence holder shall ensure that in order that the local neighbourhood is not disturbed by noise, the volume and control of any noise shall be such that it is not audible at the boundary of the nearest noise sensitive premises. Such control may include the adjustment of volume of both amplified music and public address systems, closure of doors and windows during an event, the use of noise control cut off devices and/or introduction of sound insulation.

  2              The licence holder and his/her representatives shall monitor the noise at reasonable frequencies during events. This monitoring shall be logged and made available to the Licensing Authority at it’s request.

   

  The Protection of Children from Harm

   

  3              The licence holder shall ensure that no person under the age of 18 shall be allowed on the premises at anytime.

   

• Annex 3 - Conditions attached after Hearing of Licensing Authority

   

  Works required to be completed within 28 days of 15 April 2009

   

  1              The licence holder must relocate the  two speakers on to side walls so as not to project any noise through the windows of noise sensitive house opposite the premises.

  2              The licence holder must obtain and fit a limiter on the sound equipment which is to be set in conjunction with an Environmental Health Officer of Rotherham Metropolitan Borough Council and for that item to be tamper proof.

  3              The licence holder shall ensure that additional sound insulation is provided to the two windows of the premises located within the extension, either by:-

   

                              Blocking up the windows; or

   

  The installation of a noise attenuator at the windows with a material which has high attenuation properties and supported by sound insulating curtains.

   

  4              The licence holder shall ensure that all windows and doors are to be closed when amplified music is being played.

  5              The licence holder shall ensure that the designated premises supervisor ensures the peaceful dispersal of all remaining customers at the time of closure.

  6              The licence holder shall ensure that polite notices are displayed requesting patrons to leave quietly so as to ensure that local residents are not disturbed.

  7              The licence holder shall ensure that any taxis collecting customers from the premises do so from Dun Street only.

  8              The licence holder shall ensure that no open vessels or drinks containers are taken outside the premises by customers.

  9              The licence holder shall ensure that any outside areas of the premises used by customers are closed to drinkers by 23.00.

  10              The licence holder shall ensure that regular monitoring of all outside drinking areas is carried out by suitable members of staff.

  11              The licence holder shall ensure that no drinking is allowed in the area at the front of the premises.

  12              The licence holder shall ensure that CCTV is fitted in the premises to the standards and requirements of South Yorkshire Police.
