Annex 1                             Mandatory conditions

Mandatory conditions where licence authorises supply of alcohol

1              No supply of alcohol may be made under the premises licence:-

              a              at a time when there is no designated premises supervisor in respect of the premises licence,
or
              b              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

2              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

Mandatory conditions where a licence includes a condition requiring door supervisors at specified times

3              All persons primarily engaged under or employed on the premises to vet, regulate and control persons entering the premises; or engaged, used or employed in the supervision of patrons once inside in order to ensure the maintenance of good order, public safety and internal security shall be licensed with the Security Industry Authority.

Where premises licence authorises the exhibition of films:-

4              Where the film classification body is specified in the licence, unless subsection 2(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

5              Where

a.              the film classification body is not specified in the licence, or
b.              the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,

admission of children must be restricted in accordance with any recommendation made by that licensing authority.

6              In this section -

“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).
Annex 2 - Conditions consistent with Operating Schedule

Prevention of Crime and Disorder

1              The licence holder shall ensure that a CCTV system is in operation at the premises which is set to the minimum standards set by South Yorkshire Police.
2              The licence holder shall ensure that they as premises licence holder and the Designated Premises Supervisor adhere to the Drugs and Weapons Policy set out by South Yorkshire Police.
3              The licence holder shall ensure that they maintain membership of Rotherham Licencewatch.
4              The licence holder shall ensure that a Personal Licence Holder is on the premises at all times when the premises are open to the public.
5              The licence holder shall ensure that the ‘Challenge 21’ proof of age scheme is in operation at the premises.
6              The licence holder shall ensure that no drinks or bottles are allowed to be taken from the premises.
7              The licence holder shall ensure that on nights when a baseline event or a dance event with multiple DJ’s playing at the premises (excluding the premises licence holders) every customer is searched upon entry and shall supply photographic ID and that ID is scanned using an approved ID scanning device.
8              The licence holder shall ensure on nights when a baseline event or a dance event with multiple DJ’s playing at the premises (excluding the premises licence holders) only polycarbonate drinking vessels are used at the premises.
9              The licence holder shall ensure that on all other nights that the premises are open, search upon entry will be at the discretion of management/door staff and the identification and use of the ID scanning device will be at the discretion of the management/door staff.
10              The licence holder shall ensure that polycarbonate drinking vessels are available to be used at the discretion of the management and on specific nights in consultation with South Yorkshire Police (based on intelligence or local variables).
11              The licence holder shall ensure that an ID scanner is in operation at the premises and may only cease to use the scanning device after the written agreement of South Yorkshire Police has been obtained.
12              The licence holder shall ensure that the ‘Reflective’ event and/or branding will not be hosted at the premises.

Public Safety

13              The licence holder shall ensure that there is a maximum occupancy figure in accordance with the fire risk assessment on the premises when the premises are open to the public.

The Prevention of Public Nuisance

The Protection of Children from Harm

14              The licence holder shall ensure that no customers under the age of 18 are admitted to the premises except during music events at the premises.
15              The licence holder shall ensure that persons aged 14 years and over are allowed to enter the premises when the following procedures are in place:-
a.              All persons seeking entry to the premises who appear to be under the age of 25 shall be requested to provide photographic ID.
b.              All persons aged 18 and over will be provided with a non removable wrist band confirming their age.
c.              A member of staff will be on duty in customer areas and shall check those persons consuming alcohol have the appropriate identification or proof of age to guard against the supply of alcohol to under 18s.
d.              There shall be no restriction in respect of entry of children to the first floor bar area when used independently from the ground floor area and pursuant to a private family function.
e.              No entry to persons under the age of 18 years to all other events.
Annex 3 - Conditions attached after Hearing of Licensing Authority

To permit the entry of persons aged 14 years and older to music events at the premises:-

1              The licence holder shall ensure that all sales of alcohol are from the lounge bar servery (located on the ground floor) to which access will be controlled and restricted to persons aged 18 or over.
2              The licence holder shall ensure that bars located within the club area sell non alcoholic products only.
3              The licence holder shall ensure that SIA registered door staff are present during the entirety of music events.
4              The licence holder shall ensure that licensable activities on music nights terminate at 22.30 with the closure of the premises 15 minutes thereafter.
5              The licence holder shall ensure that in respect of club nights, i.e. promoted DJs within the club area no persons under the age of 18 are allowed entry into the premises
6              The licence holder shall ensure that in respect of nights commonly known as ‘pop and crisps nights’ admission will be restricted to those persons aged between 14 years and 18 years and on those occasions no retail sale of alcohol shall take place and licensable activities will terminate at 22.30 with closure of the premises at 22.45.
7              The licence holder shall ensure that a minimum of 2 SIA registered door staff are present from 21.00 or in place at the time of opening on Friday and Saturday and on Sunday and Monday of bank Holidays when the premises operate as a club.
8              In respect of private functions limited to an occupancy of 50 persons within the lounge area ‘ground floor’ the licence holder will not be required to employ SIA registered door staff.
9              In respect of day time operation of the lounge area ‘ground floor’ until 21.00 the licence holder will not be required to employ SIA registered door staff.
10              In respect of the club area, if used during the day time until 21.00 and on the basis that no retail sale of alcohol is provided the licence holder will not be required to employ SIA registered door staff.
11              The licence holder shall ensure that during mid week when the lounge bar area is in use from 21.00 until closure a minimum of 1 SIA registered door person is present.
