does not hold a personal licence or his personal licence is suspended.\par \par \b 2\b0\f1\tab\f0 Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.\par \pard\ltrpar\nowidctlpar\fi-720\li720\cf0\b 3\tab\b0 The responsible person will take all reasonable steps to ensure that \cf1 that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.\cf0 \par \pard\ltrpar\nowidctlpar\li720\cf1 In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-\cf0\f1\par \pard\ltrpar\nowidctlpar\li1440\cf1\f0 (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to- \cf0\f1\line\cf1\f0 (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or \cf0\f1\par \cf1\f0 (ii) drink as much alcohol as possible (whether within a time limit or otherwise); \cf0\f1\line\cf1\f0 (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act); \cf0\f1\par \cf1\f0 (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less; \cf0\f1\par \cf1\f0 (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on- \cf0\f1\par \cf1\f0 (i) the outcome of a race, competition or other event or process, or \cf0\f1\line\cf1\f0 (ii) the likelihood of anything occurring or not occurring; \cf0\f1\line\cf1\f0 (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner. \par \pard\ltrpar\nowidctlpar\cf0\f1\par \pard\ltrpar\nowidctlpar\fi-720\li720\cf1\b\f0 4.\b0\f1\tab\f0 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).\cf0\f1\par \cf1\b\f0 5.\b0\f1\tab\f0 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.\cf0\f1\par \cf1\b\f0 6.\b0\f1\tab\f0 The premises licence holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.\cf0\f1\par \pard\ltrpar\nowidctlpar\li720\cf1\f0 The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.\cf0\f1\par \pard\ltrpar\nowidctlpar\cf1\b\f0 7.\b0\f1\tab\f0 The responsible person shall ensure that-\cf0\f1\par the alcohol; \par \pard\cbpat2\ltrpar\nowidctlpar\fi-709\li709 (c)\tab \ldblquote relevant person\rdblquote means, in relation to premises in respect of which there is in force a premises licence- \par \pard\cbpat2\ltrpar\nowidctlpar\fi-720\li1440 (i)\tab the holder of the premises licence, \par (ii)\tab the designated premises supervisor (if any) in respect of such a licence, or \par (iii) \tab the personal licence holder who makes or authorises a supply of alcohol under such a licence; \par \pard\cbpat2\ltrpar\nowidctlpar\fi-720\li720 (d) \ldblquote relevant person\rdblquote means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and \par (e)\tab \ldblquote valued added tax\rdblquote means value added tax charged in accordance with the Value Added Tax Act 1994. \par \pard\cbpat2\ltrpar\nowidctlpar\f1\par \pard\cbpat2\ltrpar\nowidctlpar\fi-720\li720\qj\b\f0 9.\b0 \tab Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. \par \par \pard\cbpat2\ltrpar\nowidctlpar\fi-1418\li1418\qj\b 10.\b0 (1) \tab Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (\ldblquote the first with any recommendation made by that body.\par \pard\ltrpar\nowidctlpar\li360\tx1080\f1\par \pard\ltrpar\nowidctlpar\fi-1080\li1440\tx720\tx1440\f0 1\tab Where\par \pard\ltrpar\nowidctlpar\tx720\f1\par \pard\ltrpar\nowidctlpar\fi-360\li1440\tx720\tx1440\f0 a)\tab the film classification body is not specified in the licence, or\par \pard\ltrpar\nowidctlpar\fi-360\li1440 b)\tab the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question, \par \pard\ltrpar\nowidctlpar\tx720\f1\par \pard\ltrpar\nowidctlpar\li720\f0 admission of children must be restricted in accordance with any recommendation made by that licensing authority.\par \par \pard\ltrpar\nowidctlpar\fi-349\li709 2\tab In this section -\par \pard\ltrpar\nowidctlpar\li360\f1\par \pard\ltrpar\nowidctlpar\li720\f0\ldblquote children\rdblquote means persons aged under 18; and\par \ldblquote film classification body\rdblquote means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).\par \pard\ltrpar\nowidctlpar\f1\par \b\f0 Where premises licence includes condition regarding door supervisors:-\par \b0\f1\par \f0 Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, the licence must include a condition that each individual must be licensed by the Security Industry\par \pard\ltrpar\nowidctlpar\qj\b\f1\par \f0 Annex 2\tab Conditions consistent with Operating Schedule\par \pard\ltrpar\nowidctlpar\fi-720\li1440\qj\f1\par \tab The building is to have wall mounted down lighters at intervals to provide sufficient lighting to give patrons the ability to move around the building safely and greatly reduce the light pollution caused by the existing flood lights. All the existing flood lights are to be taken down.\par \tab CCTV cameras will be fitted to the exterior of the building with high resolution low light capability. These cameras must be able to capture the face of any person outside the building 24 hours a day. All cameras must record continuously and all recording must be kept for a minimum of 6 months.\par \pard\ltrpar\nowidctlpar\qj\lang2057\f1\par \b\f0 Prevention of Public Nuisance\par \b0\f1\par \pard\ltrpar\nowidctlpar\fi-540\li540\qj\tx540\b\f0 1.\tab\b0 The licence holder shall ensure that during any hours the site is open there should be a designated person [not the licensee or DPS] on duty continually patrolling the site with the sole job of controlling parking, the safe movement of patrons about the exterior of the site, and ensuring that all external activities, arrival and departure of patrons on foot, in vehicles and smoking, are carried out quietly so as to not create a noise nuisance to the neighbourhood. \par \par \tab The licence holder shall ensure that the person appointed is vigilant and thorough and is empowered by the licensee to demand a person or persons not complying with local rules to leave the site on the grounds of creating a public nuisance that will jeopardise the future of the premises licence.\par \par \b 2.\b0\f1\tab\f0 The licence holder shall ensure that if a smoking shelter is to be provided it should be of a suitable approved construction and be sited on the southern side of the building adjacent to the "Door 2 Door" bus depot. \par \par \b 3.\b0\f1\tab\f0 Appropriation signs should be erected inside and outside the smoking shelter building indicating that it is the only allowable site for smoking and to reiterate the law regarding smoking in public places and the workplace.\par \par \b 4.\b0\f1\tab\f0 Regular neighbour contact is to be maintained. A plan to meet all the residents including those that will be resident in the new development to the south of the site to be set up, on a monthly basis, to allow residents to express their views and comments on the running of the premises. If a general meeting is not practical then each resident should be visited monthly by either the Licensee or the DPS. \par \par \pard\ltrpar\nowidctlpar\fi15\li540\qj\tx540 A contact telephone number should be given to all residents should there be the need for more immediate contact.
