responsible person will take all reasonable steps to ensure that \cf1 that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.\cf0 \par \pard\nowidctlpar\li720\cf1 In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-\cf0\par \pard\nowidctlpar\li1440\cf1 (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to- \cf0\line\cf1 (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or \cf0\par \cf1 (ii) drink as much alcohol as possible (whether within a time limit or otherwise); \cf0\line\cf1 (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act); \cf0\par \cf1 (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less; \cf0\par \cf1 (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on- \cf0\par \cf1 (i) the outcome of a race, competition or other event or process, or \cf0\line\cf1 (ii) the likelihood of anything occurring or not occurring; \cf0\line\cf1 (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner. \par \pard\nowidctlpar\cf0\par \pard\nowidctlpar\fi-720\li720\cf1\b 4.\b0\tab The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).\cf0\par \cf1\b 5.\b0\tab The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.\cf0\par \cf1\b 6.\b0\tab The premises licence holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.\cf0\par \pard\nowidctlpar\li720\cf1 The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.\cf0\par \pard\nowidctlpar\cf1\b 7.\b0\tab The responsible person shall ensure that-\cf0\par \pard\nowidctlpar\li1440\cf1 (a) where any The doors on the east side (adjacent to residencies on Ashwell Grove) shall be used solely as a fire exit in the event of an emergency and shall be closed at all other times.\par 2.\tab The licence holder shall ensure that the smoking shelter, currently located immediately outside the main entrance, is re-sited to the west side of the building at the north-west corner.\par 3.\tab The licence holder shall ensure that signs are clearly displayed at appropriate points throughout and outside the premise to inform patrons of the close proximity of residential properties and the need to conduct themselves in a way that does not cause nuisance or annoyance to local residents, particularly when leaving the premise.\par 4.\tab The licence holder shall ensure that regular contact is made with the local residents, in particular in advance of any scheduled events at the premise. This contact may be by way of a personal visit, a written communication or a meeting. Contact details for the management shall be made available for residents to liaise directly with the management in the case of complaints from noise or other nuisance or antisocial behaviour.\par 5.\tab The licence holder shall make an informal, subjective assessment of noise from loud music from the outside of the premise prior to and during any and all events involving loud music. Particular attention shall be given to the northerly (Fitzwilliam Road) side and the easterly (Ashwell Grove) side where residential properties overlook the premise. Such an assessment shall ensure that the loud music is at such a level so as not to cause a nuisance to local residents. In addition, steps shall be taken to reduce the noise from any obvious sources of noise leakage, such as the ventilation fans.\par 6.\tab The licence holder shall maintain a log of all events involving loud music shall be created and maintained at the premise, together with a contemporaneous, documented record (date, time and description of what was heard) of the subjective noise assessment described above. This log is to be available for review on request by authorised officers at any reasonable time.\par 7.\tab The licence holder shall maintain a logbook of incidents involving antisocial behaviour or refusal to serve patrons at the premise. This log is to be available on request for review by authorised officers at any reasonable time;\par 8.\tab The licence holder shall ensure that the wood burning stove shall be correctly installed according to requirements from the building control department at RMBC. Only authorised, smokeless fuels shall be used in the device.\par 9.\tab The licence holder shall ensure that windows shall be kept closed at all times during any events involving amplified music.\par 10.\tab The licence holder shall ensure that the premise shall be shut with all patrons having exited the building by the time stated on the licence and drinking-up time shall be scheduled to achieve these closure times.\par 11.\tab The licence holder shall ensure that colour CCTV cameras are installed in the entrance hall and bar areas of each bar as well as covering the smoking area. Data shall be recorded for a minimum of 14 days in order for any incidents to be reviewed. There shall be a facility for capturing any incidents and downloading them to DVD or other portable storage device for future reference.\par 12.\tab The licence holder shall ensure that the business is registered as a food-serving business with the Business Regulation team prior to the service of food at the premise.\par 13.\tab The licence holder shall ensure that children are supervised within the bar area at all times and shall not be permitted in the bar area beyond 2100hrs; \par 14.\tab The licence holder shall ensure that all commercial waste is appropriately contained in lidded, rodent-proof, lockable bins of suitable size. A contract shall be initiated with a licensed waste removal company and written proof of this shall be presented to Community Protection within \ul 2 months\ulnone of the licence being granted. This includes the provision for removal of recyclable materials such as glass.\par 15.\tab The licence holder shall maintain records relating to the removal of waste from the premise and be retained for a minimum of 2 years.\par 16.\tab The licence holder shall ensure that waste collection only takes place during working hours. If waste must be collected outside of working hours, all steps shall be taken to minimise the potential for noise nuisance to local residents.\par 17.\tab The licence holder shall ensure that residents are consulted in relation to the potential for light nuisance from existing floodlights. Appropriate adjustments shall be made to existing floodlights to ensure that a light nuisance is not caused to nearby householders.\par 18.\tab The licence holder shall ensure that any animals kept at the premise shall be cared for appropriately and every effort shall be made to ensure that animals do not cause a nuisance to local residents in relation to noise and smells.\par 19.\tab The licence holder shall ensure that the defective roof and guttering at the premise shall be inspected and appropriate repairs carried out to ensure that rainwater is captured and drains appropriately.
